The death of a family member can be a very difficult time. The assistance of an experienced attorney is often necessary to help transfer his or her real estate as well as personal property.

Massachusetts law now requires that fiduciaries keep up on the changing laws and regulations by working with accountants to file estate tax returns and fiduciary tax returns. Massachusetts laws governing the probate of estates and the laws of intestacy were recently enacted and took effect on July 1, 2011. We use our resources to comply with the most significant changes in the law.

I handle various aspects of probate and estate administration. Probate is the legal process by which an individual's will is filed and approved by a Massachusetts Probate Court, and the executor/executrix is appointed (now referred to as the personal representative). If a person dies without leaving a will but has probate assets, a personal representative must also be appointed by the probate court. Legal services may also be necessary for the transfer of non-probate assets, including interests in real estate held as tenants by the entirety or as joint tenants.

I also provide guidance with the process of establishing estate accounts, obtaining Federal tax identification numbers and dealing with creditors of an estate.
